This website is operated by Jay’s Toys and Games, a brand of Jay’s CD and Hobby LLC (“we”, “us”, “our”). Throughout the site, “Jay’s Toys and Games” refers to the store, while “Jay’s CD and Hobby LLC” refers to the legal entity. We offer this website, including all information, tools, and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you agree to be bound by the following Terms of Service (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation browsers, vendors, customers, merchants, and contributors of content.

Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use our services. Your continued use of the website following any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc., which provides the e-commerce platform allowing us to sell our products and services to you.

1. ONLINE STORE TERMS

You represent that you are at least the age of majority in your state or province of residence, or have given us your consent to allow any minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction in the use of the service.

2. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. Your content (excluding credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer.

3. PRODUCT ACCURACY AND AVAILABILITY

We strive for accuracy in product listings but do not guarantee that descriptions, images, or other content are error-free. We reserve the right to correct errors and update product information at any time.

4. PRICING, MODIFICATIONS, AND DISCONTINUATION

Prices for our products are subject to change without notice. We may modify or discontinue products or services at any time without liability.

Large Item Disclaimer: Certain oversized or heavy items may be charged a different shipping rate based on size and weight. These items may be excluded from shipping promotions, including discounted or flat-rate shipping, at our discretion. The shipping cost displayed at checkout for these items is accurate and binding.

6. RUSH & PROTECT SERVICE ADD-ON

For $2.50 per order, Rush & Protect provides:

  • Priority Processing – Your order moves to the front of our fulfillment queue.

  • Shipping Protection – Covers loss or damage during transit. If the item is no longer available, we will issue a refund.

Exclusions: Items sold as “Damaged Box,” “Store Display,” or in any condition other than “New” are excluded, as are theft after delivery confirmation, and delays not caused by loss or damage. Rush & Protect speeds up order handling, not carrier transit times.

Rush & Protect is optional, is not an insurance policy, and does not replace any rights you already have under state or federal law.

7. ORDER CANCELLATIONS & RESTOCKING FEES

Orders may be cancelled before shipment without penalty unless otherwise stated for preorders. Once an order has shipped, cancellations will incur a 10% cancellation/restocking fee. This covers processing costs and is non-refundable.

8. PREORDER POLICY

  • Preorders placed online require no deposit.

  • Your payment method will be charged only when the item is ready for shipment.

  • You may cancel your preorder at any time before it is charged and prepared for shipment with no penalty.

  • Once your preorder has been charged and shipped, cancellations will incur a 10% cancellation/restocking fee.

  • Returns for preorder items after shipment are accepted in accordance with our return policy, with return shipping costs paid by the customer.

  • We reserve the right to ban customers we believe are engaging in preorder or return abuse.

9. RETURNS & REFUNDS

Returns are accepted in accordance with our Refund & Return Policy. Customers are responsible for return shipping costs unless the return is due to our error. Certain products, including preowned items, opened merchandise, and items sold “as is,” are not eligible for return.

10. LIMITATIONS OF LIABILITY

To the fullest extent permitted by law, Jay’s CD and Hobby LLC shall not be liable for indirect, incidental, or consequential damages arising from your use of our products or services.

11. GOVERNING LAW

These Terms and any disputes shall be governed by and construed in accordance with the laws of the United States and the State of Iowa.
